Why Does a Gun Owner Need a Gun Trust?

A Gun Trust is an estate plan for your firearms.

1. National Firearms Act (NFA) Compliance

The NFA (26 U.S.C. Chapter 53) imposes strict regulations on certain types of firearms (Title II weapons), including registration, transfer taxes, and background checks. Only the registered owner may lawfully possess or use an NFA item. Unauthorized possession, even temporarily, is a federal felony.

2. Trust Law

A trust is a legal entity that can own property, including firearms. A gun trust is typically a revocable living trust specifically drafted to hold firearms and comply with federal and state law. Trustees and beneficiaries are named, and the trust can continue after the grantor’s death.

3. Estate Planning and Probate

Firearms, especially NFA items, present unique challenges in probate. Transferring such items through a will or intestacy can result in unintentional violations of federal law if the recipient is not eligible or if proper procedures are not followed.

The Silver Gun Trust is designed for the firearms collector who understands the value of proper planning when dealing with NFA items, such as suppressors, SBRs, as well as non-NFA items such as regular rifles, pistols, and shotguns.  Avoids probate and remains private.

A Silver Gun Trust has various options specifically tailored to your specific needs:

  • JOINT TRUST - If a married couple are both actively buying and selling firearms

  • INDIVIDUAL TRUST - This specifically for individuals or a married couple where only one spouse is the firearms enthusiast.

 GOLD -

Designed for those with larger collections or complex goals such as multi-state firearms ownership, multi-state transfer, separate planning for individual beneficiaries, or multi-generational planning for family benefits. Avoids probate and remains private.
